Terms of Service

Applicable to all FlowSOP users
1. Acceptance of Terms
By accessing and using FlowSOP ("the Service"), you agree to be bound by these Terms of Service. If you do not accept these terms, please do not use the Service.
FlowSOP reserves the right to modify these terms at any time. Changes will take effect upon publication on the site.
2. Service Description
FlowSOP is a SaaS platform that allows you to:
- Create and manage missions and standard operating procedures (SOPs)
- Track task execution in real-time
- Collect evidence (photos, signatures, timestamps)
- Generate automatic PDF reports
- Collaborate with field teams
The Service is provided "as is" without warranty of any kind.
3. Account Creation
3.1 Registration
To use FlowSOP, you must create an account by providing:
- A valid email address
- A username
- Organization information (optional)
You are responsible for maintaining the confidentiality of your login credentials.
3.2 Information Accuracy
You warrant that all information provided is accurate, complete, and up-to-date. You agree to update your information in case of changes.
3.3 Single Account
Each user may only create one account. Creating multiple accounts to circumvent service limitations is prohibited.
4. License to Use
4.1 License Granted
FlowSOP grants you a limited, non-exclusive, non-transferable, and revocable license to use the Service in accordance with these terms and your subscription plan.
4.2 Restrictions
You agree not to:
- Copy, modify, or distribute the Service
- Reverse engineer the software
- Use the Service for illegal or unauthorized purposes
- Attempt to access FlowSOP systems or networks in an unauthorized manner
- Disrupt or interfere with the Service
- Use robots, scrapers, or other automated means to access the Service
5. Intellectual Property
5.1 FlowSOP Ownership
FlowSOP and all its components (source code, design, logos, trademarks) are the exclusive property of FlowSOP Inc. and are protected by intellectual property laws.
5.2 User Content
You retain all rights to the content you create in FlowSOP (missions, photos, documents, comments).
By using the Service, you grant FlowSOP a limited license to store, process, and display your content solely for the purpose of providing the Service.
5.3 Backup and Export
You are responsible for maintaining backup copies of your content. FlowSOP provides export features (PDF, data) but does not guarantee data recovery in case of loss.
6. Acceptable Use
You agree to use FlowSOP responsibly and lawfully. It is prohibited to:
- Post illegal, defamatory, obscene, or offensive content
- Harass, threaten, or intimidate other users
- Violate third-party intellectual property rights
- Transmit viruses, malware, or malicious code
- Impersonate another person or organization
- Collect personal information from other users without consent
- Use the Service to send spam or unsolicited communications
7. Subscriptions and Payments
Billing terms are detailed in our Billing Policy.
In summary:
- Subscriptions are billed monthly or annually
- Payments are processed via Stripe
- Subscriptions are non-refundable except as required by law
- You can cancel your subscription at any time
8. Suspension and Termination
8.1 By FlowSOP
FlowSOP reserves the right to suspend or terminate your account without notice in case of:
- Violation of these terms
- Non-payment of subscription fees
- Fraudulent or illegal activity
- Service abuse
- Prolonged inactivity (more than 12 months)
8.2 By User
You may terminate your account at any time from your account settings or by contacting support.
After termination, your data will be retained for 30 days then permanently deleted, except where legal retention is required.
9. Privacy and Personal Data
The collection and use of your personal data is governed by our Privacy Policy.
By using FlowSOP, you consent to the collection and processing of your data in accordance with this policy.
10. Limitation of Liability
To the fullest extent permitted by law:
- FlowSOP is provided "as is" without warranty of any kind
- FlowSOP does not guarantee that the Service will be uninterrupted or error-free
- FlowSOP will not be liable for indirect, incidental, or consequential damages
- FlowSOP's total liability is limited to the amount paid in the last 12 months

11. Indemnification
You agree to indemnify and hold FlowSOP harmless from any liability concerning:
- Your use of the Service
- Your violation of these terms
- Your violation of third-party rights
- Any content you post on the Service
12. Service Modifications
FlowSOP reserves the right to modify, suspend, or discontinue all or part of the Service at any time, with or without notice.
We will strive to inform you of significant changes by email or via a notice on the platform.
13. Applicable Law and Jurisdiction
These terms are governed by the laws of the Province of Quebec, Canada.
Any dispute will be submitted to the exclusive jurisdiction of the courts of Montreal, Quebec.
If you reside in the European Union, you also benefit from protections provided by EU law.
14. General Provisions
14.1 Severability
If any provision of these terms is deemed invalid or unenforceable, the other provisions shall remain in effect.
14.2 Entire Agreement
These terms, along with the Privacy Policy and Billing Policy, constitute the entire agreement between you and FlowSOP.
14.3 Waiver
FlowSOP's failure to exercise a right under these terms does not constitute a waiver of that right.
14.4 Assignment
You may not assign your rights under these terms without FlowSOP's prior written consent.
